Don't Be Like Anna Nicole Smith and Teri Schivo!

If you are like 70% of the population, you dont have a current will even though 100% of us are going to need one. High profile cases such as Smith and Shivo are good reminders why it is so vital to have a current will that says who you would want to raise your children in case of your death and what kind of medical care you want if you can no longer communicate your wishes. There is NO reason to create the kind of drama, fighting and expense that we have seen in these two unfortunate situations. The simple solution is to have a will and health care directive. It is the last love letter you leave your family.

When I was in law school I was horrified to read all the cases about parents who died in accidents, leaving behind minor children but no directions as to who was to raise them. What almost always happens is that the custody battle between the grandparents results in such hard feelings that the winner cuts the losing side of the family out of the childrens lives. Imagine the shock of suddenly being an orphan and now you have lost your grandmother, grandfather, aunts, uncles and cousins on one whole side of the family. If you think about nasty custody battles in divorce cases you can imagine what happens when parents die without a current will. Imagine losing a child and the ONLY connection you have to your dead child is your grandchildren. Each side of the family wants custody and if you dont have a will the only way custody will be settled is in court. TOTALLY UNNECESSARY!!!

As a family law attorney I have seen some really ugly divorces. The LAST thing either side wants is to leave everything they own to their ex but that is what happens when a divorced parent dies. The minor children will not be able to take the life insurance policy, business, house or 1968 Camaro so it follows the child to the surviving parent who gets custody of the children and complete control over the dead parents estate. Wouldnt you rather have a trusted family member in charge of doling out your money to the children as they need it?

I know what you are saying, I have other more pressing things to spend money on than hiring a lawyer to do my will. I will get around to it later. I can appreciate not wanting to spend $500 on a will (Consumer Reports says the national average is $500 for a will). So how about an easy solution that will cost a lot less than $500 and give you and your spouse your own wills and updates each year, access to lawyers 24 hours a day, whenever you need one for any reason. As long as there are no drug or alcohol allegations, you have a free defense. NO car insurance covers criminal defense if someone dies in a car accident. You have prepaid hours if you are sued, 50 hours of tax attorney time if you are audited, 25% off attorney fees for uncovered matters and nighttime and weekend emergency access to attorneys within 3 rings, again on a toll free number.

What is this amazing thing? Pre Paid Legal insurance. When I saw it I immediately bought it for my family and so can you. For less than a bottle of water a day, you and your family will have the kind of security and peace of mind that has only been available to the wealthy. Can I Get Workers Compensation for a Repetitive Work Place Injury in Virginia?

It is common for a worker to work all day long and then not suffer any problem until the next day when he cannot get out of bed. This type of claim is generally not compensable under Virginia Workers Comp Law for an injured worker.

First, if you lift 50 pound widgets all day long and feel no problem but wake up the next day with a back ache, you will not have a compensable claim under Virginia Law. The rationale is you cannot tie your back injury to a "specific incident."

Second, on the other hand if you are lifting 50 pound widgets all day long and your back goes out while lifting the 99th widget, you may very well have a compensable claim. In this scenario, you can point to a "specific incident" that has caused your back injury. This is especially true if your doctor will agree the 99th wideget caused your back injury based on the history you gave to the doctor.

Third, this is why insurance companies will take recorded statements as soon as possible after an accident in order to lock in place what the injured worker's version of the accident actually was.

Fourth, the worker may be able to save the day if the worker can point to a twinge, pull, sharp pain, etc. that occurred while lifting one of the objects. Of course, the doctor will have to agree this particular event was the cause of the back injury.

Fourth, Virginia has adopted two exceptions to this repetitive injury rule for carpal tunnel syndrome and hearing loss. If the worker can establish the carpal tunnel syndrome or hearing loss was caused by work and exclude other causes, then the worker may have a compensable claim. However, problems like tendonitis will still be denied.

Nonprofit Workforce Opportunity - Women Want Better Balance in Their Hours

Women make up a large part of the nonprofit workforce, so new data on the preferences of working women may interest you.

Working moms in the United States increasingly want to work part time rather than holding down a full-time job or staying home and not working at all.

This means the nonprofit sector, which employs a large ratio of women, can be more competitive for talent by offering innovative, flexible terms of employment. There are many advantages to the organization when a person works part time. For a given 40-hour salary, you can hire two people part time and have two skill-sets for the price of one. This tends to put more burden on supervisors, however, because they have twice as many people to schedule, twice as many personnel issues, etc.

The Pew Research Center survey found that only 1 in 5 working mothers with children under 18 viewed full-time work as the best arrangement. That's down from 32 percent in 1997.

Sixty percent said a part-time job would be best, up from 48 percent 10 years ago. And 19 percent said not working outside the home at all would be ideal.

Job sharing is one solution for nonprofit employers. For certain jobs, it can be an ideal solution for all concerned. Many employers find that women who work only part time come to work energized and perform at a very high level during the hours they put in, while full-time workers performance sometimes tends to level out over the course of a 40-hour week.

Only 16 percent of stay-at-home mothers said their ideal situation would be to work full time outside the home, down from 24 percent in 1997. Conversely, nearly half now say that not working outside the home at all is the best arrangement, up sharply from 1997.

The survey was conducted by telephone among a national sample of 2,020 adults. The margin of error is 3 percentage points for the full sample, higher for various subgroups.

According to the latest federal figures, 70.5 percent of women with children younger than 18 work outside the home, 75 percent of them full time.

The survey also uncovered some differences in the way women assess their own performance as mothers. Among stay-at-home moms, 44 percent viewed so many mothers working outside the home as bad for society, 22 percent as good, and the rest said it made no difference. Among working moms, 34 percent saw the trend as positive, another 34 percent as negative.

The survey also found that mothers working full time give themselves lower ratings of themselves as parents, on average, than at-home mothers or mothers working part time.

Limit Your Liability to Protect Your Assets

If your business runs into serious difficulty, will it bring you down too? For example, what if one of your employees got involved in a serious car accident while working for you? Will the resulting lawsuit bankrupt you personally?

Here are just a few ways of protecting yourself against catastrophic losses and lawsuits.

1. Obtain Adequate Insurance Coverage

If someone slips on the sidewalk of your home and injures himself, he could sue you for damages. Your tenant`s or homeowner`s policy may cover you for liability in such an event.

However, what if it is your customer who falls on his way to visiting your home-based business? You will need an extra rider on your house insurance to cover such incidental business use. The extra charge for this additional coverage is well worth it.

If you use a car for business use, insure it for such. Some people think that they are being clever writing off automobile expenses for income tax purposes but at the same time not informing the insurance company that the car is being used for business.

This is false economy. If you ever get into an accident, police and insurance investigators will certainly find out that you used the vehicle for business purposes. If you`re not paying for business coverage, why would the insurance company cover your claim?

As well, what do you think an income tax auditor would think of your claimed business expenses on the vehicle when your insurance policy indicates personal coverage only? Avoid this additional exposure to tax liability.

Be sure to obtain required workers` compensation coverage. Some have been held responsible for all the medical and other expenses of an injured worker, as well as fines for non-compliance to the law. These costs can be quite substantial and even bankrupt you.

Consider obtaining product liability insurance. This applies not just for any products you manufacture but also for products you sell that are made by others.

2. Incorporate Your Business

Insurance may give you some protection against loss. However, you may suffer business losses and lawsuits that may not be covered by your insurance fully. What then?

An extra level of protection can be obtained by forming your own corporation. Even though incorporating yourself will result in extra paperwork and costs, it could be the best insurance you ever bought.

This is because the corporation is a seperate legal entity or person. Even though you may own the corporation, if the corporation operates the business, it is the corporation that will be sued or suffer loss.

If, for example, the corporation had severe business losses resulting in debts that could not be repaid, the corporation would be insolvent. You, as a shareholder, would lose your investment in the company but would generally not be responsible for any of its debts. Thus, you would not have to sell your home or other personal assets to cover the corporation`s liabilities.

On the other hand, there are cases where directors of a corporation can be held responsible for liabilities if they didn`t act responsibly. You can`t hide behind a corporation, commit criminal acts and expect to escape accountability.

3. Protect Yourself With Legal Agreements

Properly drafted written agreements can protect you in many ways. First of all, they can sometimes prevent misunderstandings that can lead to legal problems. Secondly, they may limit your exposure to lawsuits and losses.

Contracts can limit your exposure to liability by including provisions restricting the scope of your work and responsibility, having disputes handled by arbitration rather than through the Courts, and specifying that the maximum damages payable shall not exceed the amount of the contract.

A special area to watch out for is the Internet. There are many laws that impact on websites including matters affecting children, privacy, earnings claims, and unsolicited e-mail ("spam"). Certain agreements and notices on your website may help to protect you.

If you just want a laptop for simple web browsing and emailing, a laptop made five years ago will do the job nicely and cost you a heck of lot less. You really don't need a top of the line laptop unless of course, you're keeping up with the Jones and want the latest top model of everything. But that's moving into Dr. Phil's territory... lets not venture there!

So what do you need the laptop for?

Do you need a lightweight portable laptop for business trips or meetings? Do you need a student notebook for classes? Or do just want a desktop replacement computer that you can easily move around in your home?

Your answer will greatly determine which type of laptop you should buy.

In my case, I needed a desktop replacement that I could easily move around my home and take on very infrequent trips or vacations. Long battery life was not a major consideration because I would mainly be using it plugged into an electrical outlet. Besides, the laptop I wanted would be 7 or 8 pounds and I had no intentions of lugging that baby around over any great distance.

I work full time at home and do a lot of web design so I needed a solid machine with a lot of RAM. I also enjoy downloading and enjoying the occasional movie so a DVD Multi Drive and a wide screen display were important. High quality graphics and sound was also important for what I needed.

* RAM

RAM is to computer what location is to real estate. RAM or Random Access Memory is perhaps the most important factor to consider when buying your laptop or any computer.

RAM will greatly determine the speed of your laptop or computer. How fast it will process your tasks and graphics. You must make sure you have enough for your needs. You can now find many laptops pre-loaded with 1 Gig of RAM and capable of upgrading to 4 Gigs or more.

Compared to yesterday's computers that's a lot of RAM. If you're not into gaming, handling large video files/editing, all that RAM is not needed but it will make your laptop run faster. Also, remember if you're into gaming, Video RAM will be important -- you need a top of the line (read expensive) Graphics Card and it will increase the cost of your laptop.

Also it may be wise to buy a laptop with upgradable memory - since new applications, multi windowed browsers, streaming video... of the very near future may place high demand on your laptop's RAM.

* Dual Core Processors

CPU or Computer Processing Unit is the heart of your laptop and in this case you have Two Hearts -- Intel Centrino Duo is the front runner in this area right now. However, AMD is giving Intel some stiff competition in the dual core battle with its Athlon 64 X2 dual core processor. Either one would be a wise choice.

* Hard Drive

The amount of space or size of laptop hard drives are steadily increasing, a 100 Gig laptop is now common. If you don't want a lot of storage, buying a smaller size hard drive will save you money.

Many laptop experts choose the SATA hard drive with a high 5400 or 7200 RPM.

* Weight or Size

Perhaps the major reason you're considering buying a laptop is its size or weight -- otherwise you're better of saving your money and buying a desktop computer instead. A laptop is portable, you can carry it anywhere... tuck it under your arm and cart it to class or your next business meeting. It is ideal for taking your information and work to wherever you want to go. This portability is the main selling feature of a laptop.

Obviously you must pick the best sized laptop to suit your needs. Laptops are divided into different categories, here's a quick rundown:

Tablet PC (smallest) Size of a paper tablet or notepad, less than 3 pounds.

Ultra Portable (small) <11" x <10" Less than 1.3 inches thick, less than 4 pounds.

Thin and Light (mid-size) 11-14" x <11" 1 to 1.4 inches thick, from 5 to 7 pounds.

Desktop Replacements (largest) >13" x >11" More than 1.5 inches, more than 7 pounds and up

Pick the size that suits your purpose and use.

* Price

Laptop prices are steadily falling, it is now possible to get a quality laptop for well under a $1000. Many are selling at the $500 - $600 range. High quality gaming laptops offered by such specialty laptop makers as Alienware, Rock, will still set you back 3 to 4 grand. Ouch!

* Warranties

Don't overlook this factor, if you're buying an expensive laptop, you might want to check out these extended warranties. If you do a lot of traveling, you might need to purchase insurance against thief and loss.

* Dead Pixels Was the Only Thing I Feared!

If you can check your laptop for any dead pixels. A dead pixel will give you white spots(pixels)on your LCD display screen. Most cases you're buying your laptop straight out of the box, booting up and finding you have dead pixels is not a pleasant experience. If you want to check your laptop screen for dead pixels, just do a search for the free 'Dead Pixel Buddy' software program and run it to check your laptop for dead pixels.

* Use The Internet For Information Or Even Purchase

I run a simple Laptop Guide on one of my sites and I also keep a laptop blog so I am constantly using the Internet to gather information and compare prices. You must shop around and check out the consumer reports on the different laptop makers and the different laptop products. You must also check out the service records/reputation of the major brand names.

I researched all the different laptops and found the one that met my requirements and price. I bought it in the real world at a local Computer store mainly because I wanted to examine the laptop's graphics and keyboard in the flesh. However, I checked out all of the product's details beforehand on this store's online site -- much easier than in a busy crowded store.

Make A List

It might prove helpful to create a list of the minimum requirements or features you want on your desired laptop:

Intel Duo 1 Gig of RAM 100 Gig Hard Drive 15 Inch Screen 4 or 5 Hours Battery Life Burn/Write DVDs...

* Kick The Tires

Like buying anything, it is always a good idea to fully check out your purchase. Sample the laptop's keyboard, does typing feel comfortable? Try the touchpad, is it responsive? Open your favorite programs and check the processing speed of your laptop. Bring along a DVD and sample the sound and graphics. Take note of any problems or irritations that may pop-up, in my case it was a small right shift key but this was so minor I knew I could get used to it and it didn't stop me from buying my desired laptop.

* Research Your Laptop

Use the Internet to research your desired laptop, know exactly what components it has and know what software is already preloaded. Be careful of salespeople who will try to charge you extra for configuring or installing programs on your laptop when these programs may already be preloaded at the factory stage!

I settled on a Toshiba Satellite P100-SD3: it has Intel Duo, 1 Gig of RAM, 100 Gig Hard Drive, 17" widescreen TrueBrite Display, compatible with the new Windows Vista... it meets all my needs and I am quite pleased with my new laptop. And I will be writing a full review after I have used it for a couple of weeks... but that's another article.

If you consider most of the simple points and check out the factors listed above then making your own laptop purchase will not only be quite painless but it may even prove an enjoyable experience. Do a little homework and you will easily find the perfect laptop for you.

DWI and Blood Alcohol Concentration: What does it mean?

Blood alcohol concentration (BAC) is the relationship between the amount of alcohol consumed and the elimination of alcohol in your blood. This is usually measured as the percentage of deciliters of blood. So if it is measured by how much blood you have, your body weight makes a difference on how much you can drink. There are a few variables that determine your blood alcohol level:

-Weight

-Male or female

-Amount consumed

-How long the time frame was while drinking

-How long it takes to get back to a 0 BAC

A BAC of .04 means you have 4 drops of pure alcohol for every 10,000 drops of blood. An average man at 160 lbs. that drinks two beers would have a BAC of .04 after about an hour, on an empty stomach. Someone who reaches a BAC of .10 will normally show signs of intoxication. On average, it takes about 1 hour for 1 drink to leave the body. On women, it takes long because usually women have lower water in their body and have a higher percent of body fat than men. The fatter you are, the longer the alcohol stays in your system.

First, the alcohol is absorbed through your stomach. When you eat, then the alcohol is absorbed into the food and has to go on to the intestinal track for absorption. This takes longer for the alcohol to be absorbed. It all depends on how much you drink and how much you eat. A small amount may be absorbed through the stomach, but most alcohol is absorbed through the intestines where it enters the blood stream and travels to the brain.

Alcohol is a system suppressor along with other drugs like sedatives, painkillers and marijuana. Other drugs have a different effect on impaired driving, like cocaine and amphetamines, which are system enhancers. Alcohol impairs judgment, coordination, vision, and reaction time and increases drowsiness.

This is how your BAC is calculated and consequently gets you thrown into jail for a DWI. 35% of those convicted of DWI will become repeat offenders. Its simple, dont drink and drive.
